No Win No Fee Claim Explained

Here is a quick explaination of No Win No Fee.

IF YOU WIN YOUR CLAIM

1. Your legal fees will be paid by the losing party’s insurance.

2. Your expenses such as medical record fees, expert witness fees, etc will also be reimbursed. (most solicitors will NOT request these expenses up front, and usually defer payment of any such fees).

3. When you receive your compensation award, this will include any out of pocket expenses and where appropriate, any future losses. This award should be paid in full ie 100 Percent.

IF YOU LOSE YOUR CLAIM

1. You do not have to pay your solicitor any of the legal costs they have had to pay.

2. You may have to pay for expenses, but these will be covered by the insurance policy taken out by your solicitor.

3. If the case has been litigated, you may have to pay your opponents costs, but these again should be covered by the insurance policy.

THE COMPENSATION AWARD

Most reputable law firms in the UK now ensure that successful claimants receive 100 percent of their compensation award. This means that there are no deductions at the end of the claim from your final award.
